The New Zealand Professional Firefighters Union (NZPFU) are aware that some members are being contacted by Fair Way or a law firm to participate in interviews or provide information. We want to remind you that you cannot be compelled to participate in any interview or process.
We refer members to a previous national notice on similar situations.
Anyone who chooses to participate in any investigation or complaint process should be advised that all the information they provide including their identity should be provided in full to the parties concerned, particularly the accused for their response, and if any outcome or process is contested may be subject to any legal proceedings.
If you are not a complainant or an accused then you do not have to participate in any investigation. If you are approached and/or feel pressured please contact you Union representative for assistance and support.
The NZPFU has repeatedly raised with FENZ the serious matter of investigations and investigators extending the scope of the investigation to almost everyone in the workplace or station, regardless of whether the member is involved in the alleged issue or conduct. This has resulted in unnecessary stress and harm in the workplace including causing work colleagues to take sides and the impact ripples through the workplace on a daily basis.
It is an inherently unfair process as the accused is often told that they are not allowed to approach or talk to anyone about the allegations and any attempt to do so could result in serious disciplinary action.
The approach to you, whether by a Fair Way investigator or other person including a lawyer or FENZ personnel, may be a serious breach of confidentiality and privacy for either party involved.
It also results in unnecessary extension of time that the investigation takes.
The NZPFU is very disappointed with the actions of Fair Way as we were assured that they would not be pursuing these tactics which were part of the problem with the BCO.
The NZPFU reminds members that we have filed applications in the Employment Relations Authority contesting the implementation of the new Code of Conduct, the current investigation processes.
